TERMS AND CONDITIONS

The Effective Parent, Inc. (“TEP”) requests that you carefully read the following terms and conditions (collectively, the “Terms”) before using this web Website (the “Website”). Your use of the Website constitutes your acceptance of these Terms and your agreement to follow and be bound by these Terms. These Terms constitute a legal, binding agreement between you and TEP. There may be additional or different terms and conditions stated elsewhere on the Website that apply to your access and use of the Website. If you do not agree to these Terms, you must not access or use the Website.

Changes to the Terms

TEP may modify these Terms at any time. Those modified Terms will become effective immediately after TEP posts them on the Website. You agree to review the Terms posted on the Website each time you access or use the Website so that you are aware of any modifications made to these Terms. If you do not agree to the modified Terms, you are not authorized to access or use the Website. Your failure to comply with these Terms as they may be modified from time to time may constitute breach of contract and may violate TEP’s copyright, trademark, and other proprietary and intellectual property rights.

Modification of the Website

TEP reserves the right to modify, suspend, or discontinue, temporarily or permanently, the Website or any part of the Website from time to time, for any or no reason and without notice. You agree that TEP will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Website. TEP may change the information and materials on the Website from time to time at its discretion.

Workshops and Classes

The Effective Parent provides parent and teacher training in the form of live workshops and online classes, interactive activities, and readings to help adults improve your parenting and/or teaching skills. The Effective Parent cannot guarantee a 100% positive outcome. There will be cases when families will require more help than a parent and teacher training class can provide. It must be noted that while behavior analysis and behavioral skills training is part of the course, the course itself is not intended to provide therapy. If a family has members with persistent and serious behavioral problems, seeking the help of a social service agency or mental health professional is advised. By signing up for The Effective Parent paid workshops, you acknowledge that you have read and agree to the website’s Terms and Conditions, Privacy Policy and agree to pay for the workshop.

Privacy

To access the Website or some of the resources it offers, you may be asked to provide certain registration details or other information. It is a condition of your use of the Website that all the information you provide on the Website is correct, current, and complete.

TEP is sensitive to privacy issues with respect to the use of personal information that visitors to the Website provide. All information we collect on the Website is subject to our Privacy Policy. By using the Website, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.

Transmission of Information and Other Materials Via the Website

TEP welcomes your comments and suggestions about the Website and TEP’s products and services, but TEP does not wish for you to send any confidential or proprietary ideas, suggestions, materials, or other information relating to developing, designing, redesigning, modifying, providing, or marketing any of its products or services or any new products or services. About Children

The Website is not intended for use by anyone under the age of 13 without the prior consent and ongoing supervision of a parent or guardian. By using the Website, you represent and warrant to TEP that you meet the foregoing age requirement. TEP will not knowingly collect personally identifiable information via the Website from visitors under the age of 13 and will take prompt steps to delete any such personally identifiable information if notified that any has been inadvertently collected.

Intellectual Property

TEP owns the Website and owns or has the right to use all of the content on the Website, including all text, images, graphics, photographs, video clips, audio clips, designs, icons, wallpaper, characters, artwork, sounds, information, software, data, downloadable PowerPoint and PDF files, and other materials, and all HTML design, layouts, configurations, CGI, and other code and scripts in any format used to implement the Website (the “Content”), all of which are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. Prohibited Actions

You may use the Website only for lawful purposes in accordance with these Terms. Lifetime Access

We offer membership levels that include “lifetime” access to the Workshops. “Lifetime” access lasts for the lifetime of The Effective Parent (not your lifetime). “Lifetime” access is personal to you and is not transferable to anyone else.

References to Other Companies/Links to Other Websites

References on the Website to names, marks, products, or services of third parties or hypertext links to third-party websites do not constitute or imply TEP’s endorsement, sponsorship, or recommendation of the third parties or their products, services, or websites. TEP does not monitor or control the content of any website linked to or from the Website, and TEP is not responsible for the content of those other websites or the terms of use or privacy practices of those Websites.

Linking to the Website and Social Media Features

You may link to our homepage, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part.

Users who no longer wish to receive our newsletter or promotional materials from our partners may opt-out of receiving these communications by following the opt-out instructions provided in the e-mail.

All actions and proceedings relating to the Website or the Content will be commenced and heard exclusively in North Carolina state courts in Wake County, North Carolina or the United States District Court for the Eastern District of North Carolina. TEP and you consent to the jurisdiction of those courts.

Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

Severability and Waiver
